Homeland Security Secretary Janet Napolitano told Pelosi in a letter that she had ordered U.S. Immigration and Customs Enforcement to notify its field offices "that the interpretation of the phrase ?family relationships' includes long-term, same-sex partners."

Pelosi welcomed the federal recognition of gay and lesbian couples. At the same time, she called for more to be done to protect undocumented immigrants in long-term relationships with American citizens.

Napolitano's directive "will provide a measure of clarity and confidence to families dealing with separation in immigration cases," Pelosi said in a written statement. "Our nation is served when loving families are kept together."

But she added: "We need to ... relegate DOMA to the dustbin of history." The 1996 Defense of Marriage Act bars the federal government from extending federal benefits, such as Social Security, to married gay and lesbian couples.

DOMA restricts the Obama administration from outright ordering that gay and lesbian couples be treated the same as heterosexual couples.

Last year, Attorney General Eric Holder and President Barack Obama called DOMA unconstitutional and said they would no longer defend the measure in court. In response, the Republican-controlled U.S. House of Representatives stepped in to fund an effort to try to uphold the law.

The U.S. Supreme Court is expected to decide next month whether it will review a number of cases questioning the constitutionality of DOMA.

Meanwhile, married couples like Brian Willingham, 38, and Alfonso Garcia, 35, of Orinda, California, have been fighting for the right to be considered related in the eyes of immigration authorities. After a traffic stop, officials began deportation proceedings against Garcia, who came to the United States from Mexico when he was 14.

"We're definitely happy that the Obama administration took this good first step," Willingham told Reuters Friday. "But it's just a Band-Aid. It helps us because we are faced with deportation. But it leaves thousands of couples in exile."

Immigration officials last year said they would consider same-sex partnerships as family relations in deciding whether to deport undocumented immigrants.

But 83 members of Congress led by Pelosi and Jerrold Nadler of New York criticized the government for unevenly applying the directive, and they pressed for written guidelines.

"This is a huge step forward," said Rachel B. Tiven, executive director of Immigration Equality, a national gay-rights group. "Until now, LGBT families and their lawyers had nothing to rely on but an oral promise. The administration's written guidance will help families facing separation and the field officers who are reviewing their cases."

If this pulse propagates through the circuit it can cause data corruption that can be extremely detrimental to someone that relies on that signal, such as a person using GPS for navigation. NRL researchers have recently predicted that such effects are nearly eliminated for SWCNT-based nanoelectronics due to their small size, low density, and inherent isolation from neighboring SWCNTs in a device.

This hardened dielectric material and naturally isolated one-dimensional SWCNT structure makes them extremely radiation tolerant.

The ability for SWCNT-based transistors to be both tolerant to transient and cumulative effects potentially enables future space electronics with less redundancy and error-correction circuitry, while maintaining the same quality of fidelity. This reduction in overhead alone would greatly reduce power and improve performance over existing space-electronic systems even if the SWCNT-based transistors operate at the same speed as current technologies. From 1837 to 2010, this home stood in Trenton, Tennessee, 30 miles north of Casey Jones Village.

Townspeople climbed to its roof in 1862 to witness the Civil War Battle of Trenton. But in recent years, the house was fighting a battle of its own, surrendering its grandeur to time and the elements. It was doomed for demolition until Clark and Juanita Shaw stepped in.

Clark Shaw is the son of the late Brooks Shaw. He and his wife, Juanita, mother, Anne, and sister, Deborah Shaw Laman, help direct things at the Village.

To understand why the Shaws would care enough about a dilapidated house to bisect it, move it across town and restore it, you need some family history: Deborah calls her father, Brooks, ?the original American picker.? A country boy who worked in a country store (in the Wellwood community near Providence, Tennessee), Brooks naturally took to collecting remnants of Tennessee?s country culture when he was advised to find a way to relax following a heart attack. Deborah remembers: ?Back in the 1960s, people didn?t care about antiques the way people do now. We just went out on Saturdays and started collecting these antiques and it really became a passion.?

The family?s collection of relics from rural Tennessee overflowed, and they opened a museum and eatery near downtown Jackson in 1965. In 1978, they moved the operation to Casey Jones Village. And their penchant for picking grew ? today, Brooks Shaw?s Old Country Store is decorated with all of those old antiques (some 15,000 of them), and built with salvaged materials: wooden doors and brick floors from Edgewood, a local residence built before the Civil War; a staircase post and rail from Jackson?s erstwhile Cochran Grocery; wall boards from barns around the county.

Celebrate the grand opening of Providence House at Casey Jones Village Oct. 10. An open house will begin at 10 a.m. followed by a ceremony at 11. Those dramatic union reforms and the political theater it sparked last year turned Wisconsin Gov. Scott Walker into a Republican hero and helped balance the state?s budget.

The new rules, which curtailed bargaining rights for most unionized public employees, also sparked protests and sit-ins at the Wisconsin capitol and resulted in a major recall effort that Walker survived earlier this year, all of which seemed to cement majority political agreement with the Republican political agenda.

With its focus on a signature Republican law, Friday?s ruling also highlights a series of state and federal rulings over the last year that have turned back major tenets of a Republican agenda fueled by the massive electoral victories the party brought home in November 2010, when it took over the House of Representatives and won nine governorships. Subsequently, a large number of state voter ID laws, immigration laws, and redistricting laws passed by Republicans since 2010 have faltered, or failed, in the courts.

There are notable exceptions. A Pennsylvania judge, for example, upheld that state?s tough Republican-backed voter ID law, and federal judges have largely allowed a central tenet ? the so-called ?papers please? provisions ? passed by states in the wake of Arizona?s SB1070 law, while striking down other parts of those laws.

But from Florida to Texas, the court rejections of conservative laws, shows that the Republican revolution of 2010 has underscored political ?overreach? by Republican majorities that courts have little choice but to dismantle, Rice University political scientist Mark Jones told the San Antonio Express-News this week.

Prof. Jones goes on to say that that ?hubris or ignorance? by Republican majorities has already had more serious backlash for the party?s legislative agenda.

In Texas, for example, a ruling by a panel of federal judges this month that a redistricting map had ?discriminatory intent? against the booming Hispanic population?s voting power reconfirmed for many that Texas is not ready to be released from the strictures of the Voting Rights Act.

Republicans acknowledge that they are pushing the envelope, but disagree that what they see as a mandate from voters constitutes overreach.

DAMASCUS, Syria (AP) ? Syria accused neighboring Turkey Sunday of allowing thousands of Muslim extremists to cross into its territories, as the government and opposition said an explosion killed at least seven and cut off a main road headed south from the capital.

In letters to the U.N. Security Council and Secretary-General Ban Ki-Moon, Syria's Foreign Ministry Turkey allowed "thousands of al-Qaida, Takfiri and Wahhabi terrorists" access to the country in order to "kill innocent Syrians, blow up their properties and spread chaos and destruction."

Syrian authorities blame the anti-government uprising that began in March last year on a foreign conspiracy and accuse Gulf countries Saudi Arabia and Qatar, along with the U.S, other Western countries and Turkey, of offering funding and training to the rebels, whom they describe as "terrorists."

Turkey serves as headquarters for the leaders of the ragtag Free Syrian Army rebel group and hosts many meetings of the Syrian National Council opposition group. Relations between Turkey and Syria, once strong allies, have been deteriorating since after the crisis began last year and Ankara became one of President Bashar Assad's harshest critics.

Also Sunday, state-run news agency SANA said rebels detonated a 600 kilogram (1,320 pound) bomb under the highway near the southern town of Khirbet Ghazaleh, killing eight people and wounding 25. It said the bomb was detonated by remote control and cut the highway that links Damascus with the southern city of Daraa and the Jordanian capital of Amman.

SANA added that nine cars and two buses carrying state employees were damaged in the blast. The opposition Local Coordination Committees said seven people were killed and others wounded in the blast that it said damaged a bus.

Earlier in the day, government troops captured and cleared the neighborhood of Midan in the embattled northern city of Aleppo, SANA said, while activists reported that bombardment of rebel-held areas throughout the country claimed the lives of dozens of people.

SANA said troops also killed dozens of rebels in other parts of Aleppo, the country's largest city and commercial center. The LCC and the Britain-based Syrian Observatory for Human Rights said many of the dead in Aleppo were killed in air raids on the rebel-held neighborhood of Shaar.

The fight for Aleppo, a city of 3 million that was once a bastion of support for Assad, is critical for both the regime and the opposition. Its fall would give the opposition a major strategic victory with a stronghold in the north near the Turkish border. A rebel defeat, at the very least, would buy Assad more time.

The Observatory also said troops shelled the Damascus neighborhood of Hajar Aswad, an area that has witnessed anti-government activities since the early weeks of the uprising.

Sunday's countrywide death toll reached over 50 people, the Observatory added. It was the same day that the school year began for some five million students.

The Syrian uprising began with mostly peaceful protests in a number of the country's impoverished provinces. As security forces violently suppressed them, the protest grew and escalated into an increasingly armed insurrection. Activists say at least 23,000 people have been killed in the past 18 months.

On Sunday, the new international envoy tasked with ending the civil war, Lakhdar Brahimi, left Syria, ending a four-day visit during which he met with Assad and other officials, his office said in a statement. Brahimi summed up his first foray to Damascus Saturday with a startling and frank admission that he still has no plan for stopping the bloodshed which he warned could threaten world peace.

In Damascus, some 24 political parties and groups who describe themselves as opposition organizations gathered in an effort to seek national reconciliation and end violence in the country.

The participants, who included Deputy Prime Minister Qadri Jamil ? head the opposition party Front of Change and Liberation, said in a statement that they aim to launch a pure Syrian dialogue and call for a national conference to be attended by all opposition groups from inside and outside the country.

The Balance Scale of Wellness

Recently I had coffee with a friend who just returned fromAfricawhere he went on safari, among other pursuits, and toured the villages that line the roadways in that mostly depressed continent. He was duly impressed by both the poverty of the citizens and the happy mood most displayed when encountered. When he returned home, he said he looked around at what he had in his very comfortably furnished home and wondered aloud about why he needed all he saw. That was more than just an observation, it was a profound declaration. And it made me realize that wellness is more than just what we have that makes us happy. It?s also what we don?t have, or better yet, what we shouldn?t have that is at least as important.

It is an axiom in our society that most people spend in proportion to their income. Happy at $50,000 per year, most feel the need to increase their spending when their income reaches $100,000 per year. That begs the question, what additional purchases have been made that incrementally increase happiness and wellbeing. If we are happy at one level of income, why do we feel the need to spend twice as much when our income doubles? Often it is about keeping up with the Joneses. Or succumbing to the pressures of our children who now want Michael Jordan sneakers at $150 a pair, when earlier, a $25 pair sufficed. This phenomenon isn?t only found in the middle or upper middle class. One need not venture far to see even poor people wearing such outrageous garments when a celebrity attaches their name to the cloth or the shoe. Or consider the diamond ring so expensive it cannot be worn safely in public and instead resides in a safe-deposit box in the local bank. Do we need another, and more expensive, coffee table in the living room? Or a more expensive bed cover with lace borders rather than just plain borders? Or a swimming pool that really doesn?t increase the value of our home much at all? Maybe we think we?re doing it for the children?s future.

Most of us surely want more for our children than we had but is that good for them? Are we becoming a parental set of enablers that teach our children to shop for the most expensive even when we know we, and later on they, cannot afford it? The credit card companies bear an element of responsibility in all this. But that?s another issue. For us, the important idea is balancing what we have with what we shouldn?t have regardless of whether we can afford it or whether we sacrifice to achieve it.

The most obvious financial question becomes what should we do with the excess money if we don?t spend it on increasing satisfaction with increasing income? I wonder if a savings account ever crossed the mind of those whose income just increased. Saving for a time when unemployment rears its ugly head, or saving for disasters in the family over and above that covered by insurance seem a reasonable use of excess funds. Happiness and wellbeing are about enjoying our life with what we have, not with what we can afford.

We are constantly bombarded by advertising to entice us to buy things we heretofore have easily done without. Electronics have led the way. Do we really need an iPhone, iPad, iPod, Android, Blackberry, blueberry, strawberry, or any of the other berries now on, or likely to be on, the market? Some of them increase our security and that of our children and those definitely increase our wellbeing by reducing our anxiety for their safety. But the rest? Not likely.

The balance scale of wellness goes much further than just purchases. It encompasses attitudes, beliefs, arguments, tensions, conflicts, relationships, affairs, feelings. Most of us carry some baggage with us that should have been discarded long ago. And with baggage come tension, and worry, and often deceit. When confronted with issues that have remained hidden for long periods, most people agree that brought out in the open means a release from internal conflicts that have plagued them for decades.

A personal review of those concepts we might have within ourselves will likely determine what we keep and what we should do without. Harboring grudges long beyond their immediate value gain us nothing. Tensions hidden need to be open to the light of reason and then dismissed. There are a myriad of personal issues that fall on the side of the wellness scale requiring riddance forever. Relationships, particularly within families, need mending before death makes them moot. It is likely most of us have looked within ourselves and determined that many issues we harbor should be resolved and gotten rid of. But making it a more formal plan by treating wellness as much of what we shouldn?t have as well as what we ought to have makes resolving them so much easier. While you are creating a wellness atmosphere within your home and yourself, make a list of those wellness issues that you should do without, just as you would for those physical purchases you shouldn?t have made. Make it a sort of spring house cleaning of the mind, the body, our surroundings, our relationships, our fears, our transgressions, even our beliefs.

The balance scale of wellness can enhance one?s feeling of wellbeing. While the Scale of Justice is blind, our Wellness Scale should be out in the open, reviewed regularly, given brutally honest treatment, and maintained in a delicate balance. In our search for wellbeing what we shouldn?t have is as important and relevant as what we should have.

Obama praises lives of 4 killed in Libya

WASHINGTON (AP) ? President Barack Obama is praising the lives of four Americans killed in an attack of a U.S. Consulate in Libya and denouncing the violence and anti-U.S. mob protests in other Arab countries apparently sparked by an anti-Muslim video made in the United States.

Among the four killed was U.S. Ambassador Chris Stevens, a highly regarded diplomat and the first U.S. ambassador to die in an attack since 1979.

"Without people like them, America could not sustain the freedoms we enjoy, the security we demand, and the leadership that the entire world counts on," Obama said of the victims in his weekly radio and Internet address.

The theme echoed remarks by the president in recent days, including at a ceremony Friday at Andrews Air Force Base marking the return of the four men's remains.

The remarks allowed Obama to emphasize his role as commander in chief less than two months before the presidential election and draw attention to foreign policy, an area where he wins more approval from voters that his rival, Mitt Romney.

U.S. officials say the Sept. 11 attack of the consulate in Benghazi appeared to be connected to protests elsewhere in the Arab world, though U.S. investigators are trying to determine whether the strike was planned and was more than spontaneous anger over the YouTube video that denigrated the Prophet Muhammad.

Embassies in Egypt, Yemen, Sudan and Tunisia have also been targeted.

Obama attempted to send a message to the protesters on the street.

"This tragic attack takes place at a time of turmoil and protest in many different countries," he said. "I have made it clear that the United States has a profound respect for people of all faiths. We stand for religious freedom. And we reject the denigration of any religion - including Islam."

But, he added: "Yet there is never any justification for violence. There is no religion that condones the targeting of innocent men and women."

And he vowed to bring the attackers to justice.

"We will not waver in their pursuit," he said. "And we will never allow anyone to shake the resolve of the United States of America."

Obama's tough talk came after a week when his presidential rival, Mitt Romney, accused him of weak international leadership, especially in the Middle East and in confronting China.

The U.S. has deployed drone surveillance, an FBI investigation team, and a small surge of U.S. intelligence officers to Libya to try to track down al-Qaida sympathizers who may have used protests of the anti-Muslim video to stage the assault on the consulate.

In addition to Stevens, also killed in Benghazi were Sean Smith, an Air Force veteran who worked as an information management specialist for the State Department; Glen A. Doherty, a former Navy SEAL who worked for a private security firm and was protecting the consulate in Benghazi; and Tyrone S. Woods, also a former Navy SEAL who had served protective duty in various U.S. posts.

In the Republican radio address, Rep. Allen West of Florida called on Obama to work with Congress to replace across-the-board spending cuts that West said were a serious threat to national security. West said automatic cuts scheduled to take effect in early January would be "deeply destructive" to the military and to core government responsibilities such as patrolling U.S. borders and air traffic control.

West, who served for 22 years in the Army, said the president has balked at efforts by congressional Republicans to replace the automatic cuts, which were imposed as part of a deficit-cutting deal agreed to by both parties.

NHL on ice: Lockout all but set with no bargaining

NEW YORK (AP) ? The chance of averting an NHL lockout all but disappeared long before the midnight deadline Saturday, setting up the third major work stoppage of a major sports league in 18 months, following the NFL and NBA.

With less than an hour left, there were no signs either side would signal a desire to resume talks, all but guaranteeing NHL Commissioner Gary Bettman would make good on his vow to shut down the league at midnight EDT.

Splitting a revenue pot of $3.3 billion was the central issue.

A lockout was considered such a foregone conclusion, that an NHL spokesman said the league wouldn't even officially annouce at midnight that it actually was in effect.

"We talked with the union this morning, and in light of the fact that they have nothing new to offer, or any substantive response to our last proposal, there would be nothing gained by convening a bargaining session at this time," NHL Deputy Commissioner Bill Daly said in a statement earlier Saturday. "I'm sure that we will remain in contact in the coming days."

Barring a last-minute development, this will be the league's fourth work stoppage since 1992, and the latest chapter in labor unrest that has vexed American professional sports. The NFL was locked out for much of the offseason in 2011 while the last NBA season was shortened from 82 games to 66 and began on Christmas.

Baseball successfully reached a labor deal and some have suggested that the fact MLB didn't have a work stoppage has to do with the fact that baseball has no salary cap, allowing for more wiggle room in negotiations.

Despite a third straight day of telephone discussions between Daly and players' association special counsel Steve Fehr, the brother of NHLPA executive director Donald Fehr, hopes of face-to-face talks were dashed early Saturday.

"We suggested that the parties meet in advance of the owners' self-imposed deadline of midnight tonight," Steve Fehr said Saturday in an emailed statement to the AP. "Don Fehr, myself and several players on the Negotiating Committee were in the City and prepared to meet. The NHL said that it saw no purpose in having a formal meeting.

"There have been and continue to be private, informal discussions between representatives of both sides."

For nearly a year, Bettman has said he would lock out players when the current CBA expires. It now appears unlikely that training camps will open next week. The regular season is scheduled to begin Oct. 11, but that is also in peril.

"There's a lot of stuff that still needs to be sorted out. Hopefully things will heat up in the next couple of weeks," said forward Milan Lucic, who agreed to a three-year extension with the Boston Bruins on Saturday that will pay him an average of $6 million annually. "There's obviously a little bit of concern, but right now all you can do is stay optimistic and stay positive and hope that a deal will get done."

While the NHL lockout might not wipe out the whole season as the one in 2004-05 did, a sizeable chunk of games could be lost without productive talks soon.

In jeopardy are a couple of key dates on the calendar: the New Year's Day outdoor Winter Classic at 115,000-seat Michigan Stadium between the host Detroit Red Wings and the Toronto Maple Leafs; and the Jan. 27 All-Star game hosted by the Columbus Blue Jackets, one of the league's struggling small-market teams.

The sides traded proposals Wednesday, but neither new offer moved them closer to a deal. The lack of progress then made a lockout almost inevitable.

"I think it's fair to say there was no realistic expectation to avoid lockout as of developments on Wednesday and Thursday," Daly told the AP.

Bettman has insisted that hockey management is determined to come away with economic gains, even if it forces another work stoppage. Damage is certain to occur almost immediately, and there is no telling how jilted fans and sponsors will react to another shutdown, especially if it lasts through the fall and into the winter.

Players are concerned management hasn't addressed the league's financial problems by re-examining the teams' revenue-sharing formula. Having made several big concessions to reach a deal in 2005, the union doesn't think it should have to make more this time after record financial growth.

Once the lockout was imposed in September 2004, the sides didn't get back together until December. That stalemate was finally resolved in July 2005.

Players absorbed a salary-cap system ? the major issue then ? and took an immediate 24 percent rollback of existing contracts in exchange for 57 percent of hockey-related revenues. The NHL now says that figure is too high, and is willing to have another league shutdown to reduce that share to 49 percent to 47 percent.

Its original offer was to cut it to 43 percent, and an updated proposal raised it to 46 before another new offer pushed it a little higher Wednesday, the last time the sides met.

Instead of making a percentage-based offer, the union is seeking a deal that would guarantee players annually at least the $1.8 billion in salaries paid out last season.

Bettman said the league's latest offer would be pulled off the table once the current CBA expired because immediate damage caused by a lockout would force the NHL to reassess what it could then offer.

Without a philosophical difference this time over the salary cap, the sides merely have to figure out a way to divide hockey revenues that grew from $2.1 billion to $3.3 billion under the expiring deal.

On Friday, the Quebec labor relations board rejected a request from the players' association for a temporary injunction against a potential lockout in Quebec. But the board also ruled that more hearings are needed to make a final decision.

Donald Fehr took over as the head of the players' association in 2010 after he led baseball players through three work stoppages in the 1980s and '90s.

NHL players struck in April 1992, causing 30 games to be postponed. This would be the third lockout under Bettman. The 1994-95 lockout ended after 103 days and the cancellation of 468 games.

The most recent lockout was settled after 301 days and a month after the league would have awarded the Stanley Cup. It marked the first time a North American professional sports league lost an entire season because of a labor dispute, and the first time the Stanley Cup wasn't handed out since 1919, when a flu epidemic prevented a champion from being crowned.

iPhone 5 vs. Galaxy S3: Hardware

I'm not wild about Samsung hardware. I'll state that bias right up front. When it comes to Android, I far prefer the build and material quality of HTC to Samsung. Likewise the LCD to SAMOLD PenTile display. That said, Samsung has been improving year after year, generation after generation. It's still not at the level of HTC, much less Apple or Nokia, but it's better. Apple's is still out of this world. At roughly 20% thinner and lighter than the iPhone 4S, the iPhone 5's glass and aluminum monolith, from design to construction, simply outclass Samsung's plastic river stone.

Build aside, however, Samsung has always and continues to jam an incredible amount of specs into their flagship line, and the Galaxy S3 is not exception. While the screen remains PenTile, it's also HUGE. 4.8-inches, 1280x720 huge to be precise. That absolutely dwarf's even the iPhone 5's newly expanded 4-inch, 1136 x 640 screen. The iPhone 5's IPS in-cell display looks better and at 326 ppi vs. the Galaxy S3's 306 ppi, it's insignificantly sharper. Overall, however, size does matter. Unless you really want a screen you can use one handed, or you have tiny hipster jean pockets, or you really care about pixel perfect graphics, Samsung's bigger is bigger. (You might even be able to skip a Nexus 7 -- seriously.)

When it comes to performance, it's difficult to compare Apples to Samsungs. The iPhone 5 has the brand new Apple A6 processor, which they simply cite as being twice as fast as last year's Apple A5. Apple has a huge advantage in that they tailor make their own unique software for their own exactly matched hardware. Body and soul in one device. Samsung has to fit Google's generic software to their specific hardware. Hand at the wheel. Rumor has it, the A6 might just be the world's first production ARM Cortex A15-based processor, and that would be a big deal. To nerds. For everyone else, Samsung's 1.4GHz Exynos quad-core monster will likely be every bit as impressive. Tie.

Apple has a higher built-in storage option, at 64GB to Samsung's 32GB, but Samsung lets you put in up to 64GB of extra, micro SDHC storage. There are some cons to removable media, but not enough to stop me from giving Samsung the edge there.

Both the iPhone 5 and the Samsung Galaxy S3 have aGPS and GLONASS. both go up to 802.11n Wi-Fi at 5GHz and Bluetooth 4.0. Both can support ultra-fast 4G LTE. Apple can't do simultaneous voice and data over LTE, so if you're on AT&T/GSM, you'll drop down to still fast DC-HSPA+. If you're on Verizon or Sprint, however, you'll be offline (unless you're on Wi-Fi) just like the pre-LTE days. If you use a lot of simultaneous voice and data on Verizon or Sprint now, like looking things up on the web while talking on the phone, Samsung has the advantage. The Galaxy S3 also has NFC, which is a checkbox in its favor to be sure, but only if you frequently have a mobile payment system, check in system, or other NFC-enabled Android devices to work with. Still, winning.

Samsung had a dud of a camera in the Galaxy Nexus, but made everything right in the Android world again with the glass in the Galaxy S3. It's 8 megapixel, f2.6 shooter looked almost, if not exactly as good as the iPhone 4S' 8 megapixel, f.24 lens. We'll have to wait and see what, if any, pure photon enhancements the iPhone 5 camera offers over the 4S before we can decide this one, but once you factor in software and apps, it'll almost certainly be too close for any mainstream shopper to call.

So when it comes to hardware, the story is pretty much what it always is with Apple and Samsung: Apple wins on design, manufacturing, and elegance, and Samsung wins on size, power, and quantity of specs.

iPhone 5 vs. Galaxy S3: Software

Apple's personal digital assistant, Siri, for example, has a funner, better personality, and is tied into some helpful apps and services, but Google Now is being more aggressive when it comes to context awareness and predictive behavior than Apple. Siri will do what yo tell it. Google Now will try to figure out what to do before you tell it. Apple, however, was and is leading the charge on accessibility features for users with special needs. You don't need to be able to see or hear, for example, to get considerable value from an iPhone.

Both Apple's Safari and Google Browser/Chome will get you to your web pages. Both the iPhone 5 and the Galaxy S3 have email programs so you can get your messages. And ways to listen to music, watch videos, and do everything else you'd expect a modern mobile computing platform to do. iOS 6 on the iPhone 5, however, is one thing. The software on the Galaxy S3 is two. It's Android 4.0 Ice Creme Sandwich on its way to Android 4.1 Jelly Bean at the core, but the frosting is all Samsung's own TouchWiz interface. For some people, that's an easier, friendlier blessing that enhances the Android experience. For others, it's a blight they dearly wished Samsung would spare them by simply going stock.

The thing about most Android phones, however, and the Galaxy S3, is that you can customize and change it far beyond what Apple allows with iOS. Sure you can almost always root Android and jailbreak iOS, but you can do more, and more easily, with the Galaxy S3 than you'll be able to do with the iPhone 5, and for a while still.

So software is a similar story to hardware. Apple writes better code and creates more cohesive, consistent user experiences than Google. But Google makes code that does more things and is more customizable than Apple. Argue that all you want, but at the end of the day iOS in invariably smoother, more intuitive, and more pixel perfect than Android, yet just as invariably misses out on a lot of features Android includes as stock. If you want something that's accessible and just works, iOS has the advantage. If you want something configurable that just works the way you want it to, Android wins.

iPhone 5 vs. Galaxy S3: Services

When it comes to services that bring the internet fully to your phone, Apple has iCloud, which includes iTunes in the Cloud, iTunes Match, Photo Stream, Documents in the Cloud, Find my iPhone, Find my Friends, and more. As a service goes, it's... serviceable. It backs up and syncs your data and gives you access to all of the your iTunes content in the cloud. But Apple is still new to the cloud and they aren't as strong at it as they are hardware and software. At least not yet.

Google was born in the cloud. They're the biggest cloud services provider in the world. Android, in many ways, is a localized front end for Google's cloud. Now the localized part traditionally wasn't as good as Apple -- they just chucked web pages inside of apps -- but Google has been getting better code as well. Now their services not only still work well, but look good and perform far better than ever before.

The twist here is that you can get almost every single Google service on the iPhone 5 that you can get on the Galaxy S3. From Gmail to Google+ to YouTube to Voice Search to Drive, Google has full, robust, and increasingly good set of offerings available in Apple's App Store. (For reasons that involve the difference in business models between Apple and Google.) Samsung does add some of their own services on the Galaxy S3, for example S Voice (their version of Apple's Siri), but they tend not to be as good as Google's.

So, going with the Galaxy S3, you get almost the best Google can officer (tainted only slightly by Samsung), but nothing from Apple. Going with the iPhone 5, you get everything Apple and almost everything Google, so I'm tempted to make this category close to a tie. But there's one more kind of service.

The Apple Store. From buying your iPhone 5 to being taught how to use it to easily getting help with it when something goes wrong, Apple has hundreds of stores in dozens of countries. If you live anywhere near an Apple Store and your iPhone 5 stops working, you can go in and get it fixed, or get it swapped out for a replacement, in a matter of hours. With the Galaxy S3, all you'll have is lost time and patience as you wait for 3rd parties or the postal system.

Thanks to the Apple Store and iCloud, I've literally walked in with a damaged iPhone and walked out with a new phone with all my data and content wirelessly synced back to it in less than an hour. In that regard, no one yet comes close to Apple and the iPhone.

iPhone 5 vs. Galaxy S3: Content

Apple has a tremendous advantage when it comes to content. iTunes started earlier and is now in more countries and provides more content than anyone else on the planet. Moreover, like with services above, even if you don't like iTunes books, movies, TV shows, etc., you can also get Amazon, Netflix, Spotify, and all the other content companies right on your iPhone.

Google provides a lot of its own content now with Google Play, and Samsung fills in a lot with Samsung Hub, and you have access to enough third party content that there's no real difference. If you live in the U.S., you're almost certainly good to go. If you live outside the U.S. it can literally be the difference between being able to get legitimate content onto your phone and not.

When it comes to apps Apple used to win by default based on the sheer magnitude of numbers. That's still true for tablets, but not for phones. The Google Play Store has hundreds of thousands of apps, just like Apple's App Store, including just about every big name app and game you can think of.

Apple has also become slightly more open over time, and Android apps have become much better looking and better working. You can still knock Apple for being more controlling, both in terms of what apps you can get and how those apps can interact with each other (or not). But for some users the simplicity and security of that model trumps any neck-bearded annoyance.

Now, if you already have an iPhone or iPod touch or iPad, and a lot of iOS apps that work on the iPhone, or if you've already bought a lot of iTunes media, that can make it easier and cheaper to stick with Apple. Likewise, if you already have a lot of content from Google Play, you'll find it easier to stick with Android.

Otherwise, if you're in the U.S., you're good to go with either, and if you're outside the U.S. and really care about buying your media, check and see what's available but Apple and the iPhone 5 is your safer bet.

iPhone 5 vs. Galaxy S3: Bottom line

Like I said at the beginning, we're well past the days of obvious and easy disparities in devices. Things are more balanced and more nuanced now. And that's a very good thing for consumers. Apple's iPhone 5 and Samsung's Galaxy S 3 are both among the very best phones ever made and and you'll be well served by either one.

If there's anything you absolutely need that the iPhone 5 just doesn't provide, including a much larger screen, NFC, widgets, and other customizations, DLNA support, etc., or you just plain prefer Google and Samsung to Apple, get the Galaxy S3.

Otherwise get the sleekest, slimmest, easiest to use, most mainstream friendly, most content rich, most well supported phone in the industry -- the iPhone 5.
